In Portugal and Spain the prices of the items are identical to the prices of Clash stores. In the other countries of the European Union prices can vary depending on the destination. These values are calculated in the shopping cart, before you finish your order.
At Clash, all items sold are in perfect conditions. If you exceptionally receive a defective item, you must contact our customer support department.
If you exceptionally receive an item that does not correspond to what you requested, you must contact our customer support department.

ORDERING ON CLASHFRAGRANCES.COM
To order on www.clashfragrances.com the user must have an email account and his browser must be configured so as to accept cookies and pop-ups, in order to allow the enjoyment of all the browsing conditions of the online store.
Placing an order on www.clashfragrances.com is easy:
1. Scroll through the menus to find the products you want;
2. Check the product information such as the description, composition or the pictures;
3. Add the items to your shopping cart;
4. When you’ve added everything to your cart, proceed to checkout;
5. Review your order and select your shipping address;
6. Select one of the following payment methods: PayPal, Visa, Visa Electron, e-pay, mastercard, mastercard electronic and maestro.
7. Proceed to payment and confirm the order;
8. You will receive an order confirmation by email.
Your order is confirmed when you select the button “Confirm Payment” (Checkout) at the end of the purchase procedure. When Clash receives your order a message will appear on your screen with your order number and all the respective details. The purchase agreement is concluded at that moment. An order
confirmation is sent to your email. We suggest that you print it or download such copy for future reference.
We reserve the right not to accept your order, or to cancel it, even after its automatic confirmation.
Clash may not process orders that have no sufficient guarantee of good collection; when orders are incomplete or incorrect, or the products ordered are no longer available. In these cases, we will inform you by e-mail that the sales contract was not concluded and that we did not proceed with the sale, specifying the reasons for this.
If the products displayed on the online store (www.clashfragrances.com) are no longer available at the time of your last access or when Clash receives the request, Clash shall inform about their unavailability within 3 days after the request is received. If an order and the corresponding payment have been made regarding products that are no longer available, Clash shall refund the money paid for the unavailable items.
RIGHT NOT TO ACCEPT THE ORDER OR TO CANCEL THE PURCHASE
Clash reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even if it has already been accepted by us), in the following situations (among others), exempt from liability for any damages or costs:
* The product is no longer available/in stock (payments will be returned);
* The billing information is not correct or verifiable;
* The order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud;
* We did not receive the transfer for the payment of the order within a 5 days period after the acceptance of your order;
* If we suspect that you are under 16 years of age;
* There is an error in the price quotation;
* It is not possible to deliver at the address provided.
After receiving the order we may run some checks on the same before preparing it. These checks may include the verification of address, credibility and verification of fraud. In relation to the fraud checking we perform partially automated checks on all orders so as to filter transactions that are unusual, suspicious or that are identified as susceptible to fraud. Suspicions of fraud will be investigated and, if necessary, prosecuted. By confirming your request you are agreeing to these conditions.
BILLING ADDRESS & DELIVERY ADDRESS
The delivery address may not be the billing address. You can choose to receive your order at the office but keep your home address as the billing address and vice versa. To this end, you must indicate where you want to receive your order in step 3 of the checkout.
COUNTRY OF PURCHASE VERSUS COUNTRY OF DELIVERY
The delivery country must always coincide with the purchase country.
Portugal (mainland): between 2 and 3 working days. Delivery to the desired address is ensured by CTT between 9:00 am and 6:00 pm.
Azores and Madeira: up to 5 working days. Delivery to the desired address is ensured by CTT.
Spain (mainland): between 3 and 4 working days. Delivery to the desired address is ensured by CTT.
Balearic Islands: up to 5 working days. Delivery to the desired address is ensured by CTT.
Other countries of the European Union: between and 6 working days – Delivery to the desired address is ensured by Chronopost.
PAYMENT OF SHIPPING COSTS
The shipping rates are applied per order. The exact price of each shipment depends on the country and weight of each delivery.
Below you will find information on the shipping costs and delivery times for the different countries for packages up to 2kg.
Portugal (Mainland): 3.54€ (Free for orders over 50€) – 2 to 3 working days
Portugal (Islands): 4.50€ (Free for orders over 50€) – 3 to 5 working days
Spain: 3,50€ (Free for orders over 50€) – 3 to 4-5 working days
EU Countries except countries below: 10€ (Free for orders over 100€) – 2-3 to 6- working days
Finland, Romania, Norway, Bulgaria, Servia, Bosnia-Herzegovina, Greece: 15,0€ (Free for orders over 100€) – 5 to 10 working days
We are only able to make the delivery of an order if the delivery address is a house or an office situated in one of the countries identified in the list of countries available in the Delivery menu. To receive the order it is necessary to ensure that someone is at the address of delivery. This service does not include a scheduling or booking option. Therefore, the delivery of the order will be made without prior contact from the carrier. We do not ensure this deadline during periods of promotions, sales, Outlets, Christmas and when items are out of stock. A delivery shall be deemed to have been made or a product shall be deemed to have been delivered with the signing of the delivery receipt at the agreed address.
INSPECTION UPON DELIVERY
Upon delivery, the customer must inspect the packaging in order to verify any potential damage. If he finds that the products are damaged, the customer shall not accept the delivery of the order, which will be returned. Clash shall refund the amounts paid for the order and for the shipping as soon as the warehouse receives and completes the return procedure. Any complaint regarding the order not having been received shall be made within maximum 30 days from the date on which the order was placed. Beyond this deadline, Clash shall not be liable for its loss.
To exchange an item you shall return the item and then make a new purchase. It is not possible to exchange items purchased online, in Clash stores. Any return/exchange of items shall comply with the following condition:
Return of items in good condition (ready to be sold), with inviolate original packaging, without having been tried and accompanied by the respective invoice. If the packaging is damaged and the items present evident marks of use, we will not be able to accept the exchange nor a refund.
You have a deadline of 15 days after receipt of the order to exchange or return it.
If you prefer, contact our Customer Support via the email email@example.com, to communicate the intention to exchange or return, indicating the order number or invoice number, the products to be returned and reason. After this contact you will be given directions to follow up the exchange or return. Under no circumstances send items without prior contact because they shall not be received.
In the case of return of the order, you can choose to:
– Request a refund of the amount previously paid
– Request the shipment of a Clash voucher in the value of the amount previously paid
In either case, all requests for refund must be sent by post to the address Rua José Pereira, no. 10, Urb. Quinta do Segulim, 1685-635 Famões, indicating the references of the items and the reasons for returning them. We recommend the customer to log into his customer area on the website and to indicate that he wants to return the items, stating also the reasons for this.
The shipping costs of the return shall be borne by the customer. The refund of the amount paid shall be made within maximum 15 working days, without any costs for the customer.
RETURN OF OFFERS
The customer is entitled to the return if there is evidence that the products delivered have defects or do not comply with what was ordered. The return can be made within 30 days from the date of its receipt, always keeping the item inviolate.
Clash shall examine the returned product and inform the user of the right to the respective refund (if applicable), within a maximum deadline of 15 working days. If your complaint is justified, the value of the item and the shipping costs shall be refunded. The refund of the amount paid can be done the same way the initial payment was made or through a voucher for later use on Clash online.
ORDER CANCELLATION BEFORE SHIPPING
The customer can cancel the order, provided that it has not yet been sent. If the customer makes an order and wants to cancel it, he must, in a first moment, check the status of the order through the My Order menu, located in the upper right corner of the website’s main page. If the status of the order mentions “Registered” there is a possibility of it still being able to be cancelled.
However, the customer shall contact our Customer Support Service and request the cancellation of his order. Only after this procedure is our Customer Support Department able to request to our warehouse the cancellation of the order. If the cancellation request is successful, the customer will be notified by email of this decision and the cancellation will be processed free of charge for the customer. If the request for cancellation is not possible, the products will be shipped to the customer who, should he keep his intention to cancel the order, shall refuse to receive them. The products will be returned and, after their receipt, the refund shall be processed.

The card may be refused for several reasons, among them: the card may be expired; the card limit may have been exceeded; the data entered may be incorrect.

2. GUARANTEES AND PRICE INDICATION OF THE PRODUCT

2.2 Payment processing
If you make the payment by Credit Card we will deduct the amount due from your account as soon as your order leaves our warehouse. In the case of payment with Credit Card, all details (e.g. card number or expiration date) will be sent by encrypted protocol to the company providing the remote electronic payment services, without third parties being able to access the information transmitted. This information will not be used by Clash except to carry out the necessary procedures for the purchase or refund, in the case of a return, in accordance with the exercise of the right of return or for reporting fraud cases to the police. The products’ purchase price and the shipping costs, as indicated in the order form, will be collected from the current account when the products purchased are actually shipped.
3. ORDER SECURITY
3.1 The store clashfragrances.com uses security technologies. Your payment information will be encrypted from the moment you log in, until your transaction is processed and will not be saved on a public server. Although we use encryption software, the security of the information and payments transmitted over the Internet or via e-mail cannot be guaranteed. Clash shall not be held liable for any damage suffered as a result of the use of electronic means of communication including, but not limited to, damages resulting from
failures or delays in delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or by computer programs used for communications or transmissions of viruses.
If you choose payment by ATM Reference (Referência de Multibanco), we will begin the processing of the order after having received the payment. This may take several days. Once 5 calendar days have elapsed after the order has been placed and if we have not received any payment, the order will be cancelled. Payments can only be processed if the information to be used for billing can be verified.
4. RETENTION OF TITLE
The title to the company’s products remains vested in Clash until it has received payment in full of all these products.
5.1 The prices of the products displayed on the website contain/comprise the Value Added Tax (VAT). The shipping rates are applied per order. The exact price of the shipping rate will depend on the country where your order will be delivered.
5.2 Prices are all quoted in euros. Please note that the change of country of delivery can have influence on prices due to shipping costs.
5.3 Your total price
The total price specified in the final checkout menu includes taxes and shipping costs. The prices are quoted at the time of order confirmation, which you can print or download for future use. Please pay only the exact amount specified in the order confirmation and make individual payments per order.
5.4 Price changes
The prices of the products displayed on the website are liable to change. Clash reserves the right to change prices without notice. The prices displayed at the time of purchase are the prices applied to the transaction.
5.5 Pricing errors
Please note that even though the website is updated with extreme caution it is possible that price information on the website contains errors. Clash makes no commitment regarding supply and reserves the right to cancel your order, in the
event of such an error occurring.
6. QUALITY AND WARRANTY
Clash does not sell products that are second-hand, defective or of lower quality than the standards of those that are on the market. The main features of each product shown on www.clashfragrances.com can be found on each product page.
The products offered for sale on clashfragrances.com may not exactly match the actual clothing in terms of image and colors, due to the Internet browser and monitor used.
All products carry an identifying label. Do not remove the label of the product purchased in case you want to return such product. If you decide to exercise the right of return regarding the purchased products, Clash has the right not to accept the return of products that are returned without the label or that have been altered from their original state or damaged.
7. SHIPPING RATES
7.1 The shipping rates are applied per order. The exact price of each shipment depends on the country of delivery. For more details about the shipping price per country, please see the Shipping and returns menu on the website.
7.2 Free shipping
If the customer places an order whose value exceeds the minimum order value defined for his country or campaign, the shipment will be made free of charge, that is, for free.

9. CONDITIONS APPLICABLE TO PROMOTIONAL CODES (DISCOUNTS)
9.1 When used in accordance with the rules laid down, a promotion ode entitles the user to take advantage of a promotion/discount on the purchase of a specific product or a set of products during the period indicated/associated with the promotional code/promotional campaign.
9. Promotional codes can only be used for online purchases made on the website. The sale, exchange or donation of a promotional code is not allowed. The customer holding the promotional code shall not upload or make available a promotional code on any website or other public form of offering, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.
9.3 The promotion code is connected with the Clash brand. The use of the promotional code in connection with another brand, company or name is not permitted. The use of the promotional code in an illegal, abusive or disrespectful manner, or in any other way that may damage Clash’s reputation is also not permitted.
9.4 Promotional codes may not be accumulated with any other promotions or special offers.
9.5 The promotional codes are not interchangeable/exchangeable for money.
9.6 Clash has no obligation whatsoever to reissue or refund promotional codes. However, should Clash to decide to reissue or refund a promotional code,
9.7 In the cases where Clash reissues/refunds the promotional code, the discount of this amount can only be applied to a purchase in an amount equal or superior to the purchase in relation to which the discount/promotional code was issued.
9.8 Without prejudice to any other rights, Clash may have/has the right to invalidate immediately the promotional code in the event Clash has reasons to suspect that a promotional code is being used: in violation of the abovementioned assumptions, following theft or in other cases in which Clash has reasons to proceed in this manner.
The satisfaction of all orders placed on the website is subject to availability. Clash tries to ensure that all items offered for sale on the website are in stock. However, Clash reserves the right not to accept any orders or to cancel orders already confirmed in relation to products that no longer have stock. In these cases Clash shall inform the customer of such fact and shall refund the amount paid.
11. PROMOTION VALIDITY
The offers on the website are valid only for the time they are displayed on the website, unless otherwise reported on the website. Clash is not bound by any offer, in the event of errors or mistakes of spelling, pricing or others in the information existing on the website. Clash reserves the right to cancel any purchase and sale concluded under such errors.
12. APPLICABLE LAW
These general conditions and all disputes arising in connection with these general conditions, including their validity, the use of the website or any purchase made on it, shall be governed by Portuguese Law.
13. AMENDMENT OF THE TERMS & CONDITIONS BY CLASH
Clash has the right to amend these Terms & Conditions at any time. The customer is subject to the principles and terms in force at the time of his order, unless the law or the competent authority imposes any amendment to them.

Although Clash works its website with great care, information, texts, graphic documents, may contain errors or be incomplete or incorrect. Clash shall not be held liable for any damages resulting from the use (or inability to use) the website, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage is a result of intent or negligence on the part of Clash.
